GUEST LEGAL DOCUMENTS — WAIVERS, RELEASES & INDEMNITIES

This document contains the complete text of the legal waivers and disclaimers referenced on the Soroi Collection guest registration card. It comprises three parts: (1) the Waiver of Liability and Indemnity signed at guest registration; (2) the Spa Waiver & Medical Disclosure; and (3) the Third-Party Activity Disclaimer. Guest particulars and signatures are completed on the printed forms provided at the property. This online version is provided for reference so that guests may read the full terms at any time.

GUEST REGISTRATION & INDEMNITY FORM

Right of Admission is reserved. Each visitor enters the Soroi Collection Properties (Soroi Larsens Camp, Soroi Mara Bush Camp, Soroi Private Wing, Soroi Luxury Migration Camp, Soroi Lions Bluff Lodge, Soroi Leopards Lair, Soroi Cheetah Tented Camp, Soroi Amboseli, Soroi Samburu Lodge, or Soroi Blue Diani) and participates in the activities conducted within the Properties on a voluntary basis and at his or her own risk. Admission is subject to acceptance of the terms and conditions contained in this Agreement.

1. VALUABLES & PERSONAL PROPERTY. Safes are provided in all rooms for guests to store valuable property. Guests may also deposit property for custody at the reception desk. You are advised not to carry large amounts of cash or valuables during your travels in Kenya. Management shall accept no liability whatsoever for theft, loss, or damage of property. Any items brought onto Soroi Collection Properties, including car parks and grounds, are brought at your own risk.
2. GENERAL SAFETY. Basic first aid may be available at the Property but we are not a medical facility. In a medical emergency we will assist in contacting emergency services but are not responsible for medical outcomes. Parents and guardians are solely responsible for supervising children at all times. Outdoor events may be cancelled, postponed, or relocated due to adverse weather or force majeure. Persons under 18 years of age will not be served alcohol. We reserve the right to request valid government-issued photo identification. You agree to exercise due care and caution when walking around the Property, including reading and adhering to all cautionary signage. Rain and wet surfaces are common; any surface may be slippery when wet.
3. WILDLIFE & NATURE RISKS. You acknowledge the real hazards and risks associated with staying in wildlife areas, game and nature reserves (which may be unfenced), with close proximity to water bodies, rivers, swamps and the ocean. These include encounters with wild and dangerous animals — including but not limited to elephant, lion, buffalo, rhinoceros, leopard, hippo, crocodile, and venomous snakes and insects — as well as prevalence of communicable, tropical and other diseases, exposure to sun and heat, and unpredictable weather. You voluntarily assume all such risks.
4. BEACH & WATER SAFETY (COASTAL PROPERTIES). The beach and ocean are natural environments. Swimming, water sports, and beach activities are undertaken at your own risk. No lifeguards are on duty. We are not responsible for drowning, injuries, or accidents in the water. Observe all posted safety signs, flags, and verbal warnings. Rivers, water bodies, and the ocean may contain bacteria and other dangers; sickness, injury, or bodily harm may result upon entry.
5. SWIMMING POOL. The swimming pool is not supervised. You are fully responsible for your own safety and that of your family. You release, discharge, indemnify and hold harmless the Property from any and all loss, liability, damage, or injury arising from use of the swimming pool.
6. ACTIVITIES, TOURS & EXCURSIONS. You acknowledge that several outdoor activities (including water sports, game drives, hiking, excursions, and cultural visits) are available, which may include services, equipment, or personnel belonging to third parties. You are aware of the possibility of unanticipated risks and that involvement may result in physical or emotional injury, disease, strains, fractures, partial or total paralysis, or death. You warrant that you are physically fit to participate. Land-based activities including fitness classes, yoga, biking, and sports have risks; you agree to assume all related risks. The Property shall not be liable for any loss, damage, injury, or death resulting from such activities.
7. THIRD-PARTY SERVICES. The Property may facilitate reservations with independent third-party activity operators. The Property does not own, operate, supervise, manage, or control such activities. Your use of third-party services, including government-licensed beach vendors, is at your own risk. The Property shall not be liable for any loss, harm, injury, or death resulting from engagement with such operators or vendors.
8. FOOD ALLERGIES & DIETARY. Our kitchen handles common allergens including nuts, shellfish, dairy, eggs, gluten, and soy. Cross-contamination may occur despite our best efforts. Guests with severe allergies, food sensitivities, or dietary restrictions must inform staff directly at the time of ordering. We cannot guarantee allergen-free meals.
9. MEDICAL CONDITIONS & EMERGENCIES. You must notify the Property of any medical condition that might affect you during your stay. Guests with a pre-existing medical condition acknowledge they have consulted their physician and hereby indemnify the Property against any harm or adverse reactions. You grant the Property permission to authorise emergency medical treatment or evacuation as it deems appropriate and assume full responsibility for any payment of medical expenses incurred. The Property assumes no responsibility for any injury or damage arising from such authorised emergency treatment or evacuation. Under no circumstances shall the Property be liable for any injury, illness, or loss resulting from food allergies, infectious diseases including Covid-19, or any insect-borne or tropical disease.
10. WAIVER OF LIABILITY & INDEMNITY. Guest(s) stay at the Soroi Collection Properties at your own risk. Management shall not be liable for, and the guest(s) hereby waive(s) and abandon(s) any claims of whatever nature, including but not limited to that for theft, injury, death, loss, or damage of whatever nature, as a result of your stay or your partaking in any activities. The guest(s) hereby indemnify the Soroi Collection Properties against any claims which may arise thereof. You, your heirs, executors, successors and assigns agree to release, hold harmless, and forever discharge the Property, its owners, employees, officers, affiliates, agents, insurers, suppliers, representatives, and any third-party tour operators and travel agents with respect to any and all action, cause of action, claims and demands relating to any injury, illness, disability, death, losses, or damages of any kind whatsoever arising from or caused by your use of goods, services, amenities, and facilities offered by the Property. Management will not be liable for any indirect, consequential, or pure economic loss, or any loss of profit or goodwill.
11. CHILDREN & MINORS. Adults are to monitor the behaviour of their children to prevent any nuisance, breakage, or damage. It is agreed that children and minors are the parent’s responsibility. If a participant is under eighteen (18) years of age, the parent or legal guardian must sign the registration form. The indemnities and releases are given on behalf of both the signatory and any minor.
12. ALCOHOL & OUTSIDE DRINKS. Drinks from outside (especially alcoholic drinks) are not allowed at Soroi Collection Properties. Persons under the influence of alcohol or drugs are not permitted to use pool or recreational facilities.
13. TRAVEL & TRANSPORT. You acknowledge the dangers and risks involved in travel within Kenya, including poorly maintained infrastructure, game drives in bad terrain or weather, unmarked roads, river crossings, and travel via rail, bush plane, or other air transport. This waiver extends to purchases of off-site tours, excursions, activities, or transportation arranged through the Property, including airport transfers.
14. GOVERNING LAW & JURISDICTION. This agreement shall be legally binding and governed by and construed in accordance with the laws of the Republic of Kenya. The courts of Kenya shall have exclusive jurisdiction over any claims arising out of or in connection with your stay at the Property.

GUEST DECLARATION

I have been briefed about the risks associated with my visit to the Soroi Collection Property and/or the particular National Park, Reserve, or Conservancy (“Conservation Areas”). I have heard, understood, and accept the risks inherent in my visit to the Property and the Conservation Areas. I hereby waive any right to bring any claim, suit, or proceedings against the Property or Conservation Areas together with their employees, agents, and independent contractors, whether founded in statute, contract, equity, tort, or otherwise, related to any illness, injury, death, damage, theft, or loss suffered by me or my property arising directly or indirectly from this visit and/or my participation in any activities.

By signing the registration form, I confirm that: I have read and understood the entire contents of this document; I have had the opportunity to ask questions and seek advice; I am 18 years of age or older (or, if signing on behalf of a minor, I am the parent or legal guardian); I am signing voluntarily and without duress; and I accept the terms of this Waiver, Release, and Indemnity in full.

A parent or legal guardian may sign on behalf of a minor (under 18 years of age). Signatures are completed on the printed Guest Registration & Indemnity Form at the property, in the presence of a witness

GUEST CONSENT FORM

MEDICAL DISCLOSURE

Because massage, bodywork, and facials should not be performed under certain medical conditions, I affirm that I have stated all my known medical conditions on the spa consent form. I agree to keep the practitioner updated as to any changes in my medical profile and understand that there shall be no liability on the practitioner’s part should I fail to do so. Guests are asked to list any relevant medical conditions, allergies, recent surgeries, or medications, and to advise whether they are pregnant and of any areas to avoid.

TERMS & CONDITIONS

1. Please arrive 15 minutes before your treatment, giving you time to settle in.
2. The spa is a sanctuary of tranquillity. Phones are silenced and conversations kept hushed.
3. Share your preferences with your therapist — pressure, focus areas, ambient temperature — ensuring the experience is tailored to your needs.
4. Robes, slippers, and disposable underwear are provided. Draping ensures your privacy is always respected.
5. A jewellery box is available in your treatment room. We recommend leaving valuables in your room safe, as we cannot assume responsibility for lost items.
6. Guests under 16 years of age may only receive a gentle facial, accompanied by a parent or guardian.
7. We recommend booking your treatment in advance. Please speak to reception to make a reservation.
8. If your plans change and you need to cancel, please let us know 24 hours in advance.
9. No service charge is applied to your bill. Any gratuity is entirely at your discretion.
10. If you experience any pain or discomfort during treatment, please let your provider know immediately.
11. Any illicit or sexually suggestive remarks or advances may be considered sexual harassment and will result in the immediate termination of the session.

WAIVER OF LIABILITY

In consideration of my participation in Spa Services (massage, manicure, pedicure, depilation, facials, etc.) at the Spa (the “Facility”), I hereby release, discharge, and indemnify the Property including their respective directors, officers, employees, agents, representatives, insurers, clients, successors, assigns, and any property owners (“Released Parties”) from any and all claims, losses, damages, or liability, including losses due to the negligence of Released Parties, resulting in personal injury, accidents, or illnesses (including death), and property loss, arising from participation in Spa Services or using the Facility.

I understand that staff do not diagnose illness or prescribe medical treatments and that services rendered are not medical in nature and are not a substitute for diagnosis and treatment by a licensed medical professional.

I hereby state that my participation in the Spa Services is voluntary, and I assume all risks. Risks include, but are not limited to: bruises, improper product application, scratches, skin irritation, allergic reactions, eye injury, infection, scarring, and dermatological skin reactions.

By signing the spa consent form, I certify that I have read and understood this waiver, and I release the Released Parties from any and all liability past, present, and future relating to Spa Services at the Facility.

For guests aged 16–17, a parent or guardian must co-sign. Signatures are completed on the printed Spa Waiver & Medical Disclosure form at the property.

ACKNOWLEDGEMENT OF RISKS

I, the undersigned Guest, acknowledge and agree that:

I have voluntarily chosen to participate in the activity described on the disclaimer form (“Activity”) which is operated by the Activity Operator, an independent third-party service provider. The Activity is not operated by Soroi Collection Limited or the owner of the Property (“the Hotel”). I understand that the Hotel’s role is limited to facilitating reservations with independent third-party activity operators. The Hotel does not own, operate, supervise, manage, control, or maintain the Activity, the Activity Operator, or any equipment used in connection with the Activity.

The Activity involves inherent risks, dangers, and hazards and may result in injury including but not limited to:

• Physical injury, including bruising, sprains, fractures, cuts, and musculoskeletal injury
• Collision with other participants, vessels, equipment, or natural features
• Adverse weather, sea conditions, currents, or marine life encounters
• Equipment malfunction or failure despite proper maintenance
• Heat exhaustion, sunstroke, or dehydration
• Shock, emotional distress, or psychological harm
• In extreme cases, serious injury or death

I have been given the opportunity to ask questions about the Activity, its risks and safety procedures, and all my questions have been answered to my satisfaction. I am in good physical health and I am not aware of any medical condition, disability, or circumstance that would make my participation inadvisable. I have disclosed all relevant medical information to the Activity Operator. I meet the minimum age, fitness, competency, and any other eligibility requirements for the Activity.

WAIVER, RELEASE & INDEMNITY — RELEASE OF THE HOTEL

In consideration of the Hotel facilitating my booking of the Activity, I hereby irrevocably release, waive, and discharge the Hotel, its affiliates, holding companies, subsidiaries, officers, directors, employees, and agents from and against any and all claims, liabilities, demands, actions, causes of action, costs, and expenses of any kind arising out of or in connection with my participation in the Activity, including any claim arising from:

1. the Hotel facilitating the booking;
2. any act, omission, or default of the Activity Operator;
3. any defect in equipment used in the Activity; and
4. any risk identified in this document,

to the fullest extent permitted by applicable law.

I agree to indemnify, defend, and hold harmless the Hotel from and against all claims, damages, losses, costs, and expenses (including reasonable legal fees) brought by any third party arising from or in connection with: my participation in the Activity; my failure to comply with the Activity Operator’s safety instructions or rules; my failure to disclose a material medical condition prior to participation; my negligent or reckless conduct during the Activity; and any claim brought on my behalf by any person (including my next of kin or estate) in respect of injury, death, or loss suffered by me during the Activity.

I acknowledge that the Hotel is not directly providing this Activity and that participation is undertaken entirely at my own risk. I expressly assume all risks arising from my participation, whether or not foreseeable at the time of signing.

Where signing as the parent or legal guardian of a minor participant, the indemnities and releases are given on behalf of both the signatory and the minor, to the fullest extent permitted by applicable law. A parent or legal guardian must sign on behalf of a participant under 18 years of age. Signatures are completed on the printed Third-Party Activity Disclaimer form at the property, witnessed by a hotel representative.

GOVERNING LAW & JURISDICTION

This Waiver and Indemnity shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or in connection with this document shall be subject to the exclusive jurisdiction of the courts of Kenya.
